Man Files Multimillion-Dollar Lawsuit Against Suffolk, Va., in Garbage Truck Crash

September 19, 2006

SUFFOLK, VA – The city of Suffolk, Va., faces a multimillion-dollar lawsuit that accuses municipal officials and employees of putting motorists at risk when the city allowed its garbage trucks to park on its roads and highways to pick up trash, according to the Daily News. On behalf of the estate of his mother, Mabel Holloway, Christopher Holloway of Suffolk filed the $5 million lawsuit this week.

Holloway’s 69-year-old mother’s vehicle struck the back of a parked garbage truck in 2004, and she died from the injuries, according to the lawsuit. The family is now suing Suffolk because the city “suddenly and dangerously” parked a truck in a way that wasn’t “safely visible,” the suit alleges.

It parked the truck “intentionally in the midst of a busy traveled portion of U.S. Route 58,” where the truck obstructed traffic, the suit says. The city acted recklessly and created “a highly dangerous hazard,” the lawsuit reads. Holloway sued the city and the employees working on the truck.

City officials couldn’t comment on the suit because they haven’t received it yet, said Dennis Craff, the city’s spokesman, according to the Daily News report.

A trial date has not been scheduled.
